ORACLE Lighting, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, and representatives (collectively, “ORACLE Lighting”) design and manufacture products intended for aftermarket automotive use. By purchasing, installing, or using any ORACLE Lighting product, you acknowledge and agree to the following terms:
Installation and Use Responsibility
You are solely responsible for ensuring that any ORACLE Lighting product is properly selected, installed, and used in accordance with all applicable instructions, specifications, and vehicle requirements. ORACLE Lighting strongly recommends that all products be installed by a qualified professional with appropriate training and experience. Improper installation or use may result in product failure, vehicle damage, or personal injury.
Assumption of Risk
Aftermarket automotive modifications inherently involve risk. By purchasing or using ORACLE Lighting products, you expressly assume all risks associated with installation and use, including but not limited to risks of personal injury, death, property damage, vehicle malfunction, electrical issues, or loss of vehicle functionality. You acknowledge that ORACLE Lighting has no control over installation conditions, vehicle condition, or end use.
Compatibility and Fitness
ORACLE Lighting does not guarantee compatibility with all vehicles, systems, or configurations unless expressly stated in writing. It is your responsibility to verify compatibility prior to purchase and installation. Any guidance, recommendations, or technical support provided by ORACLE Lighting is offered for general informational purposes only and does not constitute a warranty of compatibility or performance.
Off-Road and Legal Compliance
Certain ORACLE Lighting products are intended for off-road use only, where permitted by law. You are solely responsible for determining whether the installation and use of any product complies with all applicable federal, state, and local laws, regulations, and safety standards. ORACLE Lighting makes no representation or warranty regarding the legality of on-road use and shall not be liable for any citations, fines, penalties, or legal consequences resulting from improper or unlawful use.
No Warranty of Uninterrupted or Error-Free Operation
To the fullest extent permitted by law, ORACLE Lighting disclaims any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where expressly provided in a written limited warranty. ORACLE Lighting does not warrant that its products will operate without interruption, error, or failure under all conditions.
Limitation of Liability
To the maximum extent permitted by applicable law, ORACLE Lighting shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of use, loss of profits, loss of business, vehicle downtime, towing expenses, or any other economic loss arising out of or related to the purchase, installation, or use of its products.
In all cases, ORACLE Lighting’s total cumulative liability shall not exceed the original purchase price of the product giving rise to the claim.
Release and Indemnification
By purchasing or using ORACLE Lighting products, you agree to release, indemnify, defend, and hold harmless ORACLE Lighting from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
(a) improper installation or use of the product;
(b) modification or misuse of the product;
(c) failure to comply with applicable laws, regulations, or safety standards;
(d) use of the product in a manner inconsistent with provided instructions or warnings;
(e) any injury, death, or property damage associated with the product.
No Control Over Third Parties
ORACLE Lighting shall not be responsible for the actions or omissions of installers, dealers, distributors, or end users. Any services provided by third parties are outside the control of ORACLE Lighting and are undertaken at your own risk.
Governing Law and Venue
This disclaimer and any disputes arising out of or related to the purchase or use of ORACLE Lighting products shall be governed by the laws of the State of Louisiana, without regard to conflict of law principles. Any legal action shall be brought exclusively in the state or federal courts located within Louisiana.
